GAzF3rrE NOTICE No.8902 THE OFFICE OF THE DIRECTOR OF PUBLIC PROSECUTIONS ACT (No.2 of 2013) APPOINTMENT OF TASKFORCE ON THE DECISION TO CHARGE IT IS notified for general information of the public that the Director of Public Prosecutions has appointed a taskforce on the decision to charge in exercise of the powers of the Director of Public Prosecutions conferred by Article 157 of the Constitution of Kenya as read together with section 5 of the Act. The taskforce shall comprise of- Chairperson The Secretary of Public Prosecutions Members All Deputy Directors of Public Prosecutions The Senior Assistant Director of Public Prosecutions and Head of Supreme Court and Court of Appeal The Senior Assistant Director of Public Prosecutions of the human Rights and Judicial Review Division • representative of the Law Society of Kenya • representative of the National Police Service • representative of the Directorate of Criminal Investigation • representative of the Ethics and Anti-Corruption Commission • representative of the Attorney-General • representative of the Judiciary • representative of the Independent Policing Oversight Authority • representative of the Kenya National Commission on Human Rights I. The terms of reference of the Taskforce shall be tó- review the national prosecution policy and other prosecutorial guidelines to develop a minimum standard on the decision to charge; develop guidelines on alternatives to prosecution; develop standard guidelines on preparation of case files; develop guidelines on the operationalization of a central intake of cases develop guidelines on the review of prosecutorial decisions; and (J) develop Office of the Director Public Prosecutions charge sheet formats and information, In the performance of its mandate, the Taskforce may, as the need arises co-opt not more than two other members to advise or offer assistance on any area the Taskforce may consider necessary. The Taskforce shall prepare and submit its report to the Director of Public Prosecutions together with its recommendations within thirty (30) days from the date of its appointment.
