UNDER THE WATER ACT, 2016 AND THE ACCOMPANYING DRAFT REGULATORY IMPACT ASSESSMENT REPORTS 1. Pursuant to the provisions of sections 5 (3) and 8 (1) of the Statutory Instruments Act, 2013, the Cabinet Secretary for Water and Sanitation gives notice of the preparation the following proposed statutory instruments (draft Regulations), under the Water Act, 2016: (a) The Water Services Regulations, 2019 (b) The Water Resources Regulations, 2019 (c) The Water Harvesting and Storage Regulations, 2019 (d) The Water Tribunal Rules, 2019. 2. The Cabinet Secretary further gives notice of the preparation of draft Regulatory Impact Statements to accompany the draft regulations as required by section 6 of the Statutory Instruments Act, 2013. 3. The Regulations are proposed in terms of section 142 of the Water Act, 2016 and are intended to provide additional provisions and mechanisms for the better carrying out of the Water Act, 2016. The Regulatory Impact Assessments are intended to address the anticipated impacts of the draft Regulations. 4. The drafts of the Regulations, and the Regulatory Impact Assessments Reports can be obtained from the Ministry of Water and Sanitation, Maji House, Ngong Road, Nairobi, Fifth Floor, Room 531, or accessed on the Ministry's website: www.water.go.ke ). 5. Written comments, suggestions and proposals on the draft Regulations and the Draft Regulatory Impact Statements may be sent to the Principal Secretary, Ministry of Water and Sanitation, Maji House, 5th Floor, Room 531, P.O Box 49720–00100, Nairobi. 6. The written comments, suggestions and proposals may also be sent through email: watersecretary2@gmail.com 7. The written comments, suggestions or proposals can be sent using the above means on, or by lst April, 2019. 8. The Cabinet Secretary gives notice that a Public Consultations Forum, on the draft Regulations and the Draft Regulatory Impact Assessment Reports, will be held on 25th March, 2019 at the Kenyatta International Convention Centre, Nairobi from 9 a.m. to 4 p.m. Dated the 6th March, 2019.
