GAZETTE NOTICE NO. 9951

Pursuant to section 53 (9) of the Advocates Act and Rule 12 (1) of the Advocates (Complaints Commission) Rules, 1991 it is notified for general information that from the 1st July, 2019 to 30th September, 2019, the Commission received total of two hundred and fifty one (251) new compiaints and submitted them for enquiry under the Preliminary Enquiry initiative. • 2. During the period under review, forty -three (43) complain s were classified and film opened. The nature ot new complaints classified is as shown below: - Nature of coniptaints • No. of Complaints (a) Failure to account (b) Failure to render professional services (c) Withholding funds (d) Conflict of interest (el Failure to keep client informed (/) Conduct unbecoming (g) Practising without a valid certificate TOTAL 43 3. Complaints filed against advocates/firms of advocates were disposed of in the following manner during the period: (i) Prrlintinaty Enquiry (PE) complaints. Total number of complaints closed radar the Preliminary Enquiry (PE) initiative were two hundred and My two (252). (ii)Ciassifted Complaints Total number of complainut finalized was eighty seven (87) as follows: MUSANDA (Respondent) 25 2 No. of Complaints (a) Abandoned 49 (b) Settled 12 (c) Rejected 24 (d) Referred to court 1 (e) Withdrawn 1 TOTAL 87 -4. Pursuant to section 53 (4) and in the spirit of section 53(5) of the Advocates Act, forty four (44) complaints were settled amicably at the Advocates' Complaints Commission. 5. The matters referred to the Disciplinary Tribunal (DT) during the same period for further action and in accordance with section 60(1) of the Advocates Act were nil (0). 6.
