GAZETTE NOTICE NO. 3093

PURSUANT to the County Government Act, 2012, the Physical and Land Use Planning Act, 2019, the Public Health Act (Cap. 242), Urban Areas and Cities Act, 2011 (as amended) as read with the Kisii Municipal Charter, the National Building Maintenance Policy and Building Code, Municipal Board in exercise of its Authority as delegated by the County Executive Committee gives notice to all concerned developers, owners, occupiers, agent and the general public on the following: Enforcement of Regulations. 1. Building owners are required to paint premises and ensure they are well maintained including ensuring rain water gutters are fixed to enhance rain water harvesting, and remnant splash off directed from public space and building surfaces. The owners are advised to preferably choose from white, blue and green colours when painting their premises. 2. Building owners are required to improve pedestrian walkways by paving them and removing obstruction on walkways to ensure safe and free movement. 3. All landlords are to ensure proper disposal of garbage from their premises and that none finds its way into public designated spaces. 4. All car washes on road reserves will be required to relocate to formally designated and user compatible areas and those not in compliance removed in a period of one year. 5. Pursuant to Article 69 of the Constitution property owners are to ensure portions of their land is under tree cover 6. All matatus, taxi and "boda boda" owners are to ensure their vehicles are in compliance with the National Transport and Safety Authority and must be located in their designated pick up areas as directed from time to time. 7. All external walling in private and public buildings must adhere to bylaws related to resistance to weather and damp by resisting penetration of rain 8. All building owners to ensure drainage around their building complies with the Public Health Act which requires that the owner of the building is to make satisfactory provision for the drainage of the building, or, as the case may be, require either the owner or the occupier of the building to do such work as may be necessary for renewing, repairing or cleansing the existing cesspool, sewer, drain, pipe, spout, sink or other appliance, or for filling up, removing or otherwise rendering innocuous the disused cesspool, sewer or drain. 9. All developers must adhere to the Physical and Land Use Act, 2019, relating to design of certain buildings which require that a person proposing to erect such buildings must engage for purposes of architectural design, a registered architect and for purposes of structural design, a structural engineer who must at the successful completion of the works issue a certificate certifying that the work has been carried out in accordance with the design, and complies with relevant Code of Practice.
