THE REVIEW OF THE KENYA INFORMATION AND COMMUNICATION ACT

(No. 2 of 1998)

APPOINTMENT


IT IS notified for the general information of the public that the Cabinet Secretary for Information, Communications, Technology, Innovation and Youth Affairs has appointed a taskforce be known as the Taskforce on the Review of the Kenya Information and Communication Act, 1998. The Taskforce shall comprise of the following — Chairperson: Daniel Obam Members: Juliana Yiapan Joseph Wambua Irene Kabua Victor Nzomo Robin Busolo Pauline Kimotho Terence Minishi Loice Shalakha Christopher Maina Fiona Asonga Agnes Okello Stella Wawira Joint Secretaries: Betty Kirimi Jane Migwi 1. The Terms of Reference for the Taskforce are to— (a) undertake a comprehensive review of the Kenya Information and Communication Act, 1998, identify any gaps or inconsistencies in the Act and propose specific review requirements congruent with the Information, Communication and Technology Policy Guidelines, 2020; (b) develop the following Regulations under the Kenya Information and Communication Act, 1998— (i) Sim Card Regulations; (ii) Broadcasting Regulations; (iii) Access and Infrastructure Sharing Regulations; and (iv) Interconnection Regulations; (c) undertake stakeholder and public consultations on the Regulations; and (d) perform any other activities required for the effective discharge of its mandate. 2. The Taskforce shall have power to — (a) regulate its own procedure; (b) hold meetings, public forums or consultations as it shall deem necessary in such places and at such times as the Taskforce shall consider necessary for the proper discharge of its mandate; (c) review official reports, policy, legislation or any document related to the Taskforce mandate; (d) hold consultative meetings with sector stakeholders and members of the public; (e) carry out or cause to be carried out such studies or researches as may be necessary to assist the Taskforce discharge its mandate; and (f) co-opt experts in particular areas of need as may be necessary to assist the Taskforce to discharge its mandate. 3. The term of the Taskforce shall be a period of six months with effect from the date of publication of this Notice, and the Cabinet Secretary may if necessary, extend the term of the Taskforce. 4. The Taskforce shall prepare and submit to the Cabinet Secretary — (a) a workplan and progress reports; (b) a draft of the Regulations; (c) a final report on the recommended reviews or amendments to the Kenya Information and Communications Act, 1998; and (d) an implementation matrix on actionable points. 5. The Secretariat of the Taskforce shall be based at the Communications Authority of Kenya, CA Centre, Waiyaki Way, Nairobi. Dated the 31st March, 2022.
