SCHEDULE Joint Committee on the Transfer of Functions 1. (1) The Joint Committee on the transfer of functions from the Nairobi Metropolitan Services to the Nairobi City County Government comprise. (3) The Joint Committee may, by a resolution, co-opt such persons whose knowledge and skills are necessary for the performance of its functions. (4) The co-opted members of the Joint Committee shall not exceed one third of the members of its total membership. (5) The Joint Committee may constitute such number of sub- committees as may be necessary to expedite its functions under this Framework. (6) The sub-committees constituted under subparagraph (4) shall— (a) consist of technical officers with skills and competencies necessary to undertake the functions of the Joint Committee; (b) determine its leadership and procedure for the conduct of its business; and (c) be accountable and under the directions of the Joint Committee. (b) undertake an audit of human resources in relation to the transferred functions and make recommendations pertaining thereto; (c) develop an inventory of all the assets and liabilities of Nairobi City County Government pertaining to the transferred functions; (d) receive, verify and collate reports from the sub-committees established pursuant to paragraph 1 (4) and submit the consolidated report to the Intergovernmental Relations Technical Committee; (e) analyse the policy and legal issues arising from the transfer of the functions and make recommendations; (f) refer disputes relating or incidental to the transfer of functions from Nairobi Metropolitan Services to Nairobi City County Government, to the Intergovernmental Relations Technical Committee; and (g) perform any other function as may be assigned to it by the Intergovernmental Relations Technical Committee. Powers of Committees The Committees established under this Framework shall have the power to— (a) request any information or documents from any person including any National or County Government ministry, department, agency or entity including documents relating to the existing inventory of assets; (b) require the attendance of any person before the Committee; (c) develop rules of procedure and work plans to enable them to effectively perform their functions. Co-ordinating Agency The Intergovernmental Relations Technical Committee shall co- ordinate the process of transfer of functions from the Nairobi Metropolitan Services to the Nairobi City County Government contemplated under this Framework. Functions of the Intergovernmental Relations Technical Committee (1) With reference to the transfer of functions under this framework, the Intergovernmental Relations Technical Committee shall— (a) provide for mechanisms for the transfer of functions from Nairobi Metropolitan Services to Nairobi City County Government; (b) facilitate co-operation and consultation between the national government and the county government of Nairobi City as contemplated under Articles 6 and 189 of the Constitution; (c) provide strategic directions to the Joint Committee constituted under this framework; (d) hear and determine disputes relating to the transfer of functions from Nairobi Metropolitan Services to Nairobi City County Government; (e) submit a report on the transferred functions to the following— (i) the Nairobi City County Government; (ii) the Ministry responsible for matters relating to intergovernmental relations; (iii) the National and County Government Co-ordinating Summit; (iv) the Intergovernmental Budget and Economic Council; (v) the Council of Governors. (f) perform any other functions necessary of the achievement of the objects of this Framework. Duty to Co-operate Every institution in respect of which this framework applies shall co-operate and support the Committees established under this framework to ensure that all the objectives of this framework are achieved. Duration (1) The duration of this Framework shall be for a period of one (1) month, effective the 5th September, 2022. (2) Without prejudice to the generality of sub-paragraph (l), the Intergovernmental Relations Technical Committee may, upon consultations with Nairobi City County Government and the Ministry responsible for matters relating to intergovernmental relations, extend the duration of this Framework for a period not extending one month.
