PURSUANT to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Ultra Modern Homes Limited intends to construct a residential development consisting of seven residential blocks (A, B, C1, C2, D, E1 and E2) of basement, ground plus thirteen (13) floors with a total of 350No. apartments. Residential blocks A, B, C1 and C2 will comprise of 246No. 2 bedroom units while D, E1 and E2 will comprise of 104No. 3 bedroom units, 6 bio digesters, associated facilities and amenities on Plot L.R. No. Mombasa/Block X/85 in Tudor Area, Mombasa County. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Demolition of the existing residential house • Obtain demolition permit from the County Government of Mombasa. • Recover re-usable materials for use in the proposed residential development. • Procure NEMA contractor to dispose off demolition wastes. • Comply with the Sustainable Waste Management Act, 2022. Loss of biodiversity (flora and fauna) • Landscaping of the area post construction. Increased water demand • Apply for and obtain water abstraction permit from WRA. • Liaise with Mombasa Water Supply and Sanitation Company Limited to ensure reliable supply of water to the development. • Comply with the Water Quality Regulations, 2006. Increased energy demand • Harness solar energy to power lighting system in areas such walkways and parking areas among others. • Install solar water heating systems. Solid waste generation and management • Use of overburden in backfilling and landscaping. • Procure appropriate infrastructure for solid waste management including receptacles with segregation capacity. • Designate of a waste collection area. • Procure the services of a NEMA licensed contractor. • Comply with the Sustainable Waste Management Act, 2022. Occupational safety and health risks • Register the site with DOSHS as a workplace. • Provide first aid kits at the site and train selected employees on first aid administration. 4106 4106 Impacts Mitigation Measures • Provide and enforce the use of appropriate PPEs. • Contractor should have appropriate insurance cover as per the Work Injury Benefits Act. • Comply with the Occupational Safety and Health Act, 2007. Noise pollution • Use serviceable machinery. • Sensitize truck drivers to avoid unnecessary hooting and running of vehicle engines. • Comply with the Noise Regulations, 2009. Air pollution • Install appropriate and adequate dust screens around the project site. • Sprinkle water at the excavation areas to suppress fugitive dust. • Use serviceable machinery/equipment and trucks. • Comply Air Quality Regulations, 2014. Traffic congestion • Erect signage and warnings along the road to forewarn other road users on the use of the road by HCVs. • Offload construction materials on the site and not on the road reserves to ensure smooth flow of traffic. • Sensitize drivers to observe the designated speed limit along the road. • Comply with the provisions of the Traffic Act, 2016. Impacts of climate change • Incorporate climate change proofing in the design of the proposed residential development. • Comply with the Climate Change Act 2023 and National Climate Change Action Plan 2018- 2022. Security concerns • Provide adequate guards, radio and alarm back- ups. • Install CCTV cameras at strategic locations within the development. • Control access to the development at all times. • Provide adequate lighting along the sky streets and the fence areas of the development. Fire risks and emergency preparedness • Develop, clearly display and implement a fire and emergency response action plan. • Install appropriate firefighting equipment at strategic locations within the development. • Firefighting equipment should be serviced by fire service providers. • Designate a fire assembly point and clearly display emergency exit points at strategic locations within the development • Undertake regular inspection and maintenance of electrical appliances. Effluent management • Monitor the quality of the domestic effluent to ascertain conformity to the standards stipulated under the Third Schedule of Environmental Management and Coordination (Water Quality) Regulations, 2006. • Apply for and obtain an Effluent Discharge License (EDL) from NEMA. • Comply with the provisions of the Environmental Management and Coordination (Water Quality) Regulations, 2006.
