PROBATE AND ADMINISTRATION
NOTICE is given that any person who has grounds of opposition to the registration of any of the trade marks advertised herein according to the classes may, within sixty (60) days from the date of this Gazette, lodge notice of opposition on form TM.
No. 6 (in duplicate) together with a fee of KSh. 1,500 (local application) or US$ 75 (foreign application).
Notice is also given that official objection will be taken under rule 21 (3) to all applications in which the specification claims all the goods included in any class unless the registrar is satisfied that the claim is justified by the use of the mark which the applicant has made, or intends to make if and when it is registered. Where an applicant considers that a claim in respect of all the goods included in a class can be justified it will save unnecessary delay in examining applications if a claim is filed simultaneously with the application, accompanied in appropriate cases by supporting documents.
The period for lodging notice of opposition may be extended by the registrar as he thinks fit and upon such terms as he may direct.
Any request for such extension should be made to the registrar so as to reach him before the expiry of the period allowed.
Formal opposition should not be lodged until after reasonable notice has been given by letter to the applicant for registration so as to afford him any opportunity of withdrawing his application before the expense of preparing the notice of opposition is incurred. Failure to give such notice will be taken into account in considering any application by an opponent for an order for costs if the opposition is uncontested by the applicant.
Where it is stated in the advertisement of the applicant that the mark, upon its registration, is to be limited to certain colours, the colours are, as far as possible, indicated in the accompanying representations of the mark in the usual heraldic manner.

Every objection in respect of an application shall be lodged with the licensing authority and the district commissioner of the district in which such application is to be heard and a copy therefore shall be sent to the applicant not less than seven (7) days before the date of the meeting at which such an application is to be heard. Objections received late will not be considered except where otherwise states that the applications are for one vehicle.
Every objector shail include the registration number of his/her vehicle (together with timetables where necessary), operating on the applicant’s proposed route. Those who submit applications in the names of partnerships and companies must bring certificates of business registration to the Transport Licensing Board meeting.
Applicants who are Kenya, Tanzania or Uganda citizens of non-African origin must produce their certificates or any other documentary proof of their citizenship.
