THE ENVIRONMENTAL MANAGEMENT AND CO-ORDINATION ACT

(No. 8 of 1999)

PURSUANT to regulation 2] of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, National Housing Corporation, proposes to develop the NHC Stoni Atht Housing Project, Phase 2, sector A and B of 7-storey comprising 96No. two bedroom and 64No. three bedroom units with a total of 160 units in each sector totaling to 320 units, parking space for each unit, other associated facilities and amenities on plot L.R. No. 10426/81 in Mavoko, off Mombasa Road, Machakos County. The following are the anticipated impacts and proposed mitigation measures: Impacts Proposed Mitigation Measures Risk of non- ¢ Submit the proposed project’s architectural compliance with drawings to the Machakos County statutory Government for approval before requirements commencing the implementation. * Make application and payment for water supply and sewer connection to Mavoko Water and Sewerage Company (MAVWASCO). * Obtain an EIA License from NEMA before the commencement of the construction phase. ¢ Ensure that a copy EIA License and the EIA report are filed at the project site during the entire period of the construction phase. * Register the project with NCA prior to commencenient of works. * Register the construction site as a workplace with DOSHS before the commencement of the construction phase. * Submit the proposed project’s architectural drawings for approval to DOSHS. * Contractor to nominate a safety supervisor for the construction and submit the nominees’ name to DOSHS relevant office. ° Strictly adhere to the general and EIA License Conditions. * The proposed project proponent and the implementing contractor comply with 11th February, 2022 Impacts Loss of vegetation and biodiversity Soil erosion Noise and excessive vibrations pollution Dust and emissions pollution Proposed Mitigation Measures Covid-19 containment measures. See appendix V for the containment measures. Have well-maintained documentation to efficiently maintain and optimize licenses acquisition and acquire information such as business needs, purchased items, valid entitlements, solutions, services or software in use, lifecycle data, usage policies, etc. Have clearly defined roles and responsibilities that outline ©=EMP implementation protocol on inter alia, who carries out the implementation, and how these processes are communicated to the employees or users. Conduct annual environmental audit on the estate once the initial audit is done one year after operation commences. Develop a decommissioning plan and submit it to NEMA 3 months before the commencement of decommissioning work. Undertake an EIA for decommissioning and submit it to NEMA. Register the decommissioning site with DOSHS. Clear the materials not used at the end of the construction phase to allow for the regeneration of vegetation. Restore the land through appropriate landscaping preferably by indigenous species once the construction phase is over. Appropriate soil conservation measures be put in place to reduce the erosion effect. Contractor develop a detailed erosion and sediment control plan before commencing construction. To schedule soil excavation during low rainfall periods and to excavate immediately before construction instead of leaving soil exposed for long periods. Control concentrate flow and run-off to reduce the volume and velocity of water from work sites Have windbreaks to minimize wind erosion. Provide the workers with personal protective equipment (PPE’s) like earplugs and muffs to protect them from the generated noises and enforce their usage. Ensure that the machinery and equipments used are well serviced, to minimize the noises they generate. Set speed limits to regulate the speed at which the trucks move at and around the site of the proposed project. The machinery, equipments and vehicles used to be those that produce minimum noise and vibrations and if not be fitted with silencers. Provide the construction workers with Personal Protective Equipment (PPE) such as respiratory masks. Set speed limit for the trucks while using the access road and on the site to reduce the dust emission. Water the site and access road to reduce the dust emissions. Soil generated during excavation be either disposed of or enclosed and watered to suppress the dust it may produce during windy days. Provide sufficient and appropriate PPEs and enforce their usage by anybody on-site Provide enough fully stocked first aid kit at the site and train adequate first aiders. Contractor ensure all machines are used for the appropriate functions or purposes. Ensure that all people involved understand the technical operations of various types ot machinery, in addition to _ providing instruction manuals for the various equipment. Have an incident/accident register. Provide emergency signage at the site, adequate lighting and barriers where need be. Put in place a fire safety system. Put in place an elaborate fire escape system/route. Comply with fire safety laws. Undertake fire drills. Have regular inspection and fire safety audit. Clear exit paths and fire assembly point. Provide for formal communication between workers, contractors and the neighbors which will address among other complaints raised. Put up educative awareness. Signage {oO create Provide VCT services and awareness creation on matters of HIV/AIDS and sexually transmitted infections. Provide condoms 1n installed dispensers’ onsite. Provide security personnel and other security measures onsite. Inspect the security fence regularly to check that no illegal entry points have been created. Construction site access be controlled and be granted to authorized persons only. No mixing of concrete to occur within 50 m of any watercourse. Appropriate concrete containment structures be provided. All fuel storage be appropriately bonded. Machinery and equipment have drip trays to contain any potential leakages of fuels and oils. Ablutions for the construction workers to be provided. All sewerage be contained and transported within the effluent management systems. The building materials purchased have minimal packaging to avoid the generation of excessive packaging waste. Put measures in place for frequent waste collection. The households be facilitated with waste carrier bags in the form of flat bags that are color-coded on weekly basis Proponent ensures maintenance is done frequently. In the event of blockage or leaks of pipes and the need for plumbing services, urgent attention should be ensured. The proponent apply for effluent discharge license from NEMA for the septic tanks. The proponent ensure rain and storm water is channeled into drainage systems to avoid dumpy compound. The proposed project be installed with an energy-efficient water heating system. The proposed project be installed with a Jow volume or dual flush system in the toilet or the use of a vacuum toilet that can reduce water usage per flush. The bathrooms are installed with water- efficient showerheads. Protessional design and siting be put into consideration. The proposed flats are sited in a location within the master plan on the site which precludes the possibility of having an aesthetic resource within its view shed. Use of Non-Specular Materials. This entails using building materials that do not shine may reduce visual impacts. Use of screens where circumstances prevent the realization of optimal sitting and sometimes engineering, economic, or where other constraints preclude optimum dimensioning or other appropriate design treatments. Improve the drainage along with the access road to the project site. Proposed project incorporate auxiliary features e.g., recreational facilities. street lighting, community hall, playfield, open spaces, and commercial centers to ease pressure on existing utilities and infrastructures. Consider alternative sources of energy and water such as solar and roof rainwater harvesting. The proponent — should incorporate water and energy-saving features in the project design to ease pressure on water and power supply needs. New residents be issued with the NHC code of conduct that will guide cohesion between them and the community. Adequate notices to interested and affected parties (IAP) should made of the impending decommissioning to make arrangements for alternative housing arrangements. Business associated with the development should be notified of the intention of decommissioning in good time to relevant adjustment. Workers be notified early in advance about the decommussioning plan to find other alternative sources of income or compensated for losing their means of livelihood.
