IN EXERCISE of the powers conferred by sections 120 and 121 (1) (a) and (b) of the Electric Power Act,.and in recognition of the prevailing adverse weather conditions and scheduled intensified power rationing, the Electricity Regulatory Board has revised the schedule of clectricity tariffs and rates sct on 1st August, 1999, by establishing new categorics of large commercial and industrial consumers and setting the electricity tariffs and rates contained in the schedule hercin below. , The cicctricity tariffs and rates sct shall take effect on 29th May, 2000 and shall for cach customer become cffective so as to apply to all bills raised. and bascd on meter readings in respect of clcectric-consumption taken on or.after 29th May, 2000. All other:charges, rates terms and conditions as contained in the schedule’ of electricity tariffs arid rates of Ist August, 1999 remain in effect. Copies of the revised schedule of cicctricity tariffs and rates are available for public inspection without payment of any fees at any customer scrvice offices of the Kenya Power & Lighting Company Limited throughout the Republic of Kenya during official working hours. Any person upon the payment of Kenya shillings twenty (20) only may obtain copics of the revised schedule of electricity tariffs and rates from the said offices. Gazette Nonice No. 3276 THE ELECTRIC POWER ACT (No. 11 of 1997) IN THE MATTER OF THE ELECTRICITY REGULATORY BOARD AND IN.THE MATTER OF A DISPUTE UNDER SECTION 6 OF THE SCHEDULE TO THE ELECTRIC POWER ACT BeErwEEN PAN AFRICAN PAPER MILLS (B.A.) LIMITED—(Consumer) AND THE KENYA POWER AND LIGHTING COMPANY LIMITED—{ Licensee) Decision WHEREAS the consumer requested for a hearing before the Board under section 6 (1) of the schedule to the Electric Power Act, No. 11 of 1997, the Board has conducted a hearing whercat the consumer and the licensee have. made oral and written submissions raising several issues for determination, And whereas the Board has reached a decision on these issucs. Now therefore the Board issucs this Gazette Notice under section 6 (4) of the schedule to the Electric Power Act aforementioned and States its decision as follows: (a) Tie Board finds that the consumer qualifics to negotiate a large retail contract for the supply of clectrical cnergy with the licensee undcr the Electric Power Act. It is also the finding of the Board that the current supply agreement between the consumer and the licensee docs not qualify to be regarded as a large retail contract within the meaning of sections 2, 21 (1) and 121 (1) (f) of the Electric Power Act. (b) The Board finds that the consumer is not entitled to any ‘compensation from the licensee by way of tariff rebate on account of the consumcer’s financial contribution to the construc- tion of the 132 kV supply linc extension to its paper mill located at Webuyc. The licensee is only obliged to provide compensa- tion to the consumer in respect of new supply connections from the 132 kV supply linc by virtuc of section 28 (1) (ii) of the Electric Power Act. (c) The Board rulcs that it can not impose or compel a large retail agreement on the partics. (d) The Board confirms that the cost of supplying power at 132 kV is lower than that of supplying power at 66 kV and has accordingly ordered that the consumer be removed from category C3 band of consumers and placed under a new category C5 for large commercial and industrial consumers whose consumption is in excess of 7,500,000 kWh/month. (e) The Board has ordered that the following clectricity tariffs and rates be charged by the licensce in respect of the consumption of electrical energy by the consumer at its paper mill located in Webuyc: Fixed Charge Unit Rate Demand Charge (KSh./Month) (KSh./kWh.) (KSh./kVA) 7500 4.00 80 The electricity tariffs and rates set and the new category C 5 of large commercial and industrial consumers shall come into cffect on 29th May, 2000. (f) The Board has declined to exercise its discretion to back-date its award.
