WHEREAS (1) Janendra Raichand Shah, (2) Virchand Mulji Malde and (3) Ratilal Ghela Samat, all of P.O. Box 82802, Mombasa in the Republic of Kenya, are registered as proprietors of that piece of land known as Mombasa/Block XII/4, situate in the Mombasa Municipality, Mombasa District, and whereas sufficient evidence has been adduced to show that the said certificate of title issued thereof has been lost, notice ts given that after the expiration of fourteen (14) days from the date hereof, { shall issue a provisional certificate of title provided that no objection has been received within that period. Box 30550, Nairobi, and whereas the said Samson Kanywuiro, has also executed a charge in favour of Stanbic Bank Kenya Limited, of P.O. Box 30550, Nairobi, and whereas affidavits have been filed in terms of section 65 (1) (h) of the said Act declaring that the said certificate of title registered as 1.R. 37522/1, is not available for registration, notice is given that after fourteen (14) days from the date hereof provided that no objection has been received within that period, I intend to dispense with the production of the said certificate of title and proceed with the registration of the said instrument of transfer and charge.
