WHEREAS Charo Kazungu Kadzomba, of P.O. Box.38, Kilifi in the Republic of Kenya, is registered as proprietor of that. piece of land known as parcel No. Kilifi/Ngerenyi/561, situate in the district of Kilifi, and whereas the resident magistrate’s court at Malindi, in civil case No. 54 of 1994, has.ordered that the. said piece of land be transferred to Kazungu Chai, of P.O. Kilifi, and whereas the executive officer of the said court has in pursuance to an order of the said court executed a transfer of the said piece of land in favour of Kazungu Chai, of P.O. Kilifi, and whereas all 4th September, 1998 land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof provided no valid objection has been received within that period, I intend to dispense with. the production of the said land title deed and proceed with. the registration of the said instrument of vesting order and issue a land title deed to the said Kazungu Chai, and upon such registration the land title deed issued earlier to the said Charo Kazungu Kadzomba, shall be deemed to be cancelled and of no effect. Box 29, Ugunja, and whereas the executive officer of the said court has in pursuance to an order of the said court executed a transfer of the said piece of land in favour of (1) Domtila Awino Omuga and (2) Margaret Nyawade Onyango, both of P.O. Box 161, Ukwala, and whereas the executive officer of the said court has in pursuance to ‘an order of the said court executed a subdivision and transfer of one of the said piece of land in favour of Cosmas Sewe Ongwano, of P.O. Box 18, Bar Ober, and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof provided no valid-objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said instrument of transfer and issue a land title deed to the said Charles Oboch Otieno, and upon such registration the land title deed issued earlier to the said Bonifas Oduor Ndeda, shall be deemed to be cancelled and of no effect.
