WHEREAS E. Nijiru Njeru, of P.O. Embu in the Republic of Kenya, is registered as proprietor of that piece of land containing 0.40 hectare or thereabouts, known as parcel No. Ngandori/ Kirigi/4128, situate in the district of Embu, and whereas the principal magistrate’s court at Embu, in civil suit No. 299 of 1994, has ordered that the said piece of land be transferred to Njeru Nguu, of P.O. Box 312, Embu, and whereas the executive officer of the court has in pursuance to an order of the said court executed a transfer of the said piece of land in favour of Njeru Nguu, of P.O. Box 312, Embu, and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof provided no valid objection’ has. been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said instrument of transfer and issue a land title. 17th July, 1998 deed to the said Njeru Nguu, and upon such registration the land title deed issued earlier to the said E. Box 13, Silibwet in the Republic of Kenya, is registered as proprietor of that piece of land known as parcel No. Nyandarua/Silibwet/716, situate in the district of Nyandarua, and whereas the principal magistrate’s court at Nyahururu, in civil suit No. 56 of 1997, has ordered that the said piece of land be transferred to Moses Maina Macharia, of P.O. Box 13, Silibwet, and whereas the executive officer of the court has in pursuance to an order of the said court executed a transfer of the said piece of land in favour of Moses Maina Macharia, of P.O, Box 13, Silibwet, and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said instrument of transfer and issue a land title deed to the said Moses Maina Macharia, and upon such registration the land title deed issued earlier to the said Margaret Wangui Maina, shall be deemed to be cancelled and of no effect.
