WHEREAS Gailey and Roberts Co-operative Savings and Credit Society Limited, of P.O. Box 30067, Nairobi, is the registered proprietor as lessee of that piece of land containing 2.347 hectares or thereabout, known as Ni. L.R. 209/7141/4, situate in the city of Nairobi, held under lease registered as I.R. 26788/1, and whereas the said Gailey and Roberts Co ‘operative Savings and Credit Society Limited, has executed an instrument of further charge in favour of the Co-operative Bank of Kenya Limited, a bank duly constituted under Co- operative Societies Act, having its registered office, of P.O. Box 48231, Nairobi, and whereas affidavit has been filed in terms of section 65 (1) (4) of the said Act, declaring that the said Jease registered as No. 0.R. 26788/1 is. not available for regis- tration, notice is given that after fourteen (14) days. from the date hereof provided that no objection has been received within that period, I intend tto dispense with the production of the said lease and proceed with the registration of ithe said. instru- ment of further charge. a Dated the 27th March, 1998. Yala in the Republic of ‘Kenya, is registered as proprietor of that piece of land’ known as parcel No. North ‘Gem /'Ndert/554, situate in Siaya District, and whereas the senior resident magistrate’s court at Siaya, in civil suit No. 48 of 1998, has ordered that the said piece of land be transferred to (1) Samuel Andiwo Wasambwa and (2) Peter Ochieng Wasambwa, both of P.O. Box 332, Kisumu, and whereas the executive officer of the court has in pursuance of an order of the said court executed a transfer of the said piece of land in favour of (1) Samuel Andiwo Wasambwa and (2) Peter Ochieng Wasambwa, both of P.O. Box 332, Kisumu, and whereas all efforts made to compel. the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from ‘the date hereof, provided no valid objection has been received within that period, I intend to dispense with the pro- duction of the said land title deed and proceed with the regis tration of the said instrument of transfer and issue a land title deed to the said (1) Samuel Andiwo Wasambwa and (2) Peter Ochieng Wasambwa and upon such registration the land title dead issued earlier to the said Peter Oduor Obadha, shall be demeed to be cancelled and of no effect.
