For the purposes of thrs Report , under section 59 (l) (r, the board is required to evaluate and report to the County Assembly (of Siaya) the extent in which the value and principles referred to in Article 10 and 232 of the Constitution of Kenya are comphed with within the pubhc service of Siaya County Government. 2.I ARTICLE IO AND ARTICLE 232 OF THE CONSTITUTION OF KENYA Article 10 provides for national values and principles of governance while Article 232 provides for values and principles of Public Service. 2.1.1 Article l0 of the Constitution of Kenya Provides for national values and pnnciples of governance which brnds all state organs, state officers, public officers and all persons whenever aly of them applies or lnterprets this Constitution, enacts, applies or lnterprets any law, or makes or implements public policy decisions. These include; . Patriotism, national unity, sharing and devolution ofpower, the rule ofthe law. democracy and participation ofthe people. . Human dignity, equity, social justice, inclusiveness, equality, human rights, non discrimination and protection of the marginalized. . Good governance, integrity, transparency and accountability. . Sustainabledevelopment. Siaya County Public Service Board has carried out its statutory duties beanng in mind and applying the tenets of Article l0 of the Constitutron of Kenya,2010. The board has promoted and continues to promote in the county public service of Siaya County Government the values and principles statcd in Article 10. 2.2 APPLICATION OF VALUES AND PRINCIPLES IN ARTICLE IO Considerations in appointment has been made based on: . Regional balancing; to ensure that the successful applicants are considered according to their Sub-counties, wards and counties of origin. This will ensure patriotism, national unity, sharing and devolution of power. . Competitive recruitment and selection for all vacant posts though advertisements rn widely circulated media outlets. This ensuresl the rule of law, democracy and people's participation. The board has also encouraged and utilized the services of experts and multr-stakeholders in this respect. ' Accessrbilrty of the board's services. This system ensures equity, socral justice, inclusiveness, equality, human rights and non discrimination, and protectron of the marginahzed. ' Evaluation of Recruitment and selection process through a board Report to all stakeholders and interested parties. This ensures good govemance, instills integrity, transparency and accountability in the process. ' The board has ensured sustainable development in the county through equrty and social justrce rn sourcing of quahfied staff to offer qtnlity services to the county. The board is enhancing the same through a Strategrc Plan 201412019. ' The board has continuously provided advrsory to the county government to ensure good govemance and promotion of the values and pnnciples. Such advisones have included but not limited to the following; ' Advising the county government to create the office ofthe County Attorney and forward the request to the board to competitively sourcc for competent officer to carry out the mandate of such office. . Advising the county government to properly establish the Ministries. Thrs was necessitated by the challenges that were faced during recruitment and selectlon exercise. , . Advising the county govemment on the need to adhere to and respect the good labour practice, rndustrial and employee relations. 2.2.1 ARTICLE232 OFTHECONSTITUTION Atticle 232 provides for values and principles of Public Service which include: ' Highstandardofprofesstonalethics,efficient,effectrveandeconomrcuseof resources . Responsrve, prompt, effectrve, impartial and equitable provision of servrces. ' Involvement of the people in the process of policy maklng, accountabilrty for administrative acts. . The selectron of the Board Members was competltlvely done. This ensured recruitment and selectton of professronals tn various disciplines to malntatn high standards of professional ethics, efficiency, effective and economic use of resources. . The board works through Commrttees to ensure responsrve, prompt, effective, impartial and equrtable proviston of servtces. . The recruitment process, field visits and the envisaged Strategic Plan2Ol4-2O19 and the County Public Service Board Bill 2015 (proposed), rnvolves people's partrcrpatron through stakeholder engagement, open and compeutive processes, to ensure people's views are taken into consrderatlon. . The board responds to all the audit queries, enquines from the pubhc and other statutory organs of the County responsible for checks and balances . The board ensures timely and accurate rnformation sharing though reports and lT based systems. Interviewees are requested to make comments after conclusron of the formal rntervrew; . The board, through selechon process, ensures balancing of successful Candidates on gender. rnclusion of non-dominant groups as well as persons wrth disabilrty . The board accords equal opportunrtles for appointments, facilitates training opportunities and advancement at all levels of Public Servico in the County Government of Siaya. However, the recruitment process is underway as follows; 3.3 Secrctary to the County Public Service Board The Secretary to the Public Service Board resigned in the month of May 2014 and the process to recruit a new one is underway as stated below; 3.3 Chief Officers (2) The selection for Chief Offrcer - Roads, Public Works and Infrastructure and Trade, Industrialization and Cooperative Development are underway. The Chief Officer Roads, Public Works and Infrastructure has been advenised four (4) times due to failure to attract a suitable candidate. The post of the Chief Officer Trade, Industrialization and Cooperative Development was advertised because the successful candidate declined the appointment. Male and Female candidates excelhng rn drfferent professional skrlls and capacrtres . Technrcal professrons such as accounts, engrneenng and dlvrng which attracts fewer female applrcants than their male counterparts . Other freld based professrons such as Sub County and Ward Admrnrstrators also attracted fewer female candrdates owrng to the strenuous and ngorous nature of the trainrng and the Job. In conclusion the Board notes that gender balance rvill be attarned gradually However. the Board contlnues to encourage female applicants during advertlsements for vacancres in the varrous cadres. 4.2 RESIDENCE BY MARRIAGE VIS.A.VIS BIRTH Capturing data of apphcants especially female apphcants during data entry and short lrsting per Sub- county and wards creates confusion, At short listing. a candidate's rdentifrcation documents may indrcate that she is from a partrcular Ward, whereas at the time of intervrew she clalfies that shc is from a drfferent ward. Such clarms requrres proof such as Affrdavrt or Marrrage Certrfrcate rvhrch candrdates normally lack Such confusion affects the allocatron of appolntments and balancrng rn the wards and Sub counties. 4 3 REGIONAL BALANCING Whereas the board would want to uphold the requrrement of regronal balancrng wrthrn the County, there have been challenges when it comes to meetrng mlnrmum requrrements as per the advertrsed vacancles across the county. AppLcants from certarn areas are usually drsadvantaged due to therr levels of qualrfrcatrons. The board has however had to rnvoke affrrmatrve measures to mltlgate these challenges to ensure equity and social justice The board supplements adverts on print medra wlth electronlc partrcularly the local vernacular radlo stations to reach a wider audience. The board further launched rts websrte rn October,2014 at wwwsiaya.cpsb.co.ke to further reach even a more wrder audience. 4.4 DIVERSE COMMUNITIES Sraya County rs largely not cosmopolltan. Peoplc fronr other ethnlc communltles are present ln the county mostly as publrc servants. students or members of the minority business communrty. AppLcants for various vacancies are few and mainly from the nerghbolng countres. The law requires that the Dominant Ethnic Group be 70per cent and non-Dominant Ethnic Group be 30 per cent according to section 65 (l) (e) of the County Governments Act, No.17 of 2O12. However, certain vacancres do not attract applicants from outside the Domrnant Ethnlc Group. To mitigate this, the Board has at times resorted to head huntrng. As at now, Non- Dominant Ethnic Group stands at 5.93 per cent. It is the voluntary personal decision of an apphcant to choose to respond to a vacancy announcement, however, lt ls the duty of the county govemment and by extenslon the Board to assure the eligible candrdates ofstability rnjob tenure. The Board has stnved to ensure this through advertisements by indrcating at all trmes that Sraya County is an equal opportunlty employer. 4 .5 POLITICAL ENVIRONMENT The board recognrzes the fact that it operates wlthrn a polrtical environment amongst others This therefore can affect certain aspects of recruttment and selection exercise and by extensron the board's activrtles. The board holever stflves to remaln apolrtrcal whrle at the same tlme encourage consultatron and consensus buildrng in the drscharge of lts dutres and dehvering on rts mandate. 4.6 INADEQUATE INFRASTRUCTURE Inadequate infrastructure is still a challenge rn Sraya County as a whole and therefore by extension affects the Board's intentron to attract competitive candrdates and qualifred personnel in rts Pubhc Servrce. Some of the neighboring Counties are better off rvhen it comes rnfrastructure development thereby attracting applicants due to the same The Board has noted that even some successful candidates are still compelled to seek residence in other Countres due to this challenge particularly when rt comes to educational rnstrtutions, resrdentral houses, ICT, medrcal facilrtres and road networks. 4.7 PERSONS WITH DISABILITY Advertised positlons have so far attracted few people hving with disabilities The board is currently looking at ways and means of capturrng data on disabrlrties among the applrcants. Despite the challenge. there have been people Lvrng lvrth drsabilrty as successful candrdates 4 8 INADEQUATE FUNDING In the Frnancral Year 2Ol4l20l5 the board budgeted for Kshs. 107 Million for rts operatrons. However, the board was allocated KSh. 53 Million whrch rs less that 50 per cent of rts budget. Thrs has posed a challenge rn the effectrve and effrcrent dehvery of servrces. For example, the allocation of Kshs. 3Million for advertisement has already been exhausted as at November, 20 l4 thereby hampenng recruitment and selectron exercrse 2nd January,2015 THE KENYA GAZETTE 4 9 OFFICE SPACE The board's offices are currently located at Ardhr House, Bondo. The Board rs accommodated rn the premrse on tenancy basts. Thrs poses the followrng challenges: . Commuter and shuttle drfficulties to and from the County headquarters. . Inadequate office space and Board rooms to host both the Board Members and the Board's Secretariat . Lack of security, particularly for documents, rnformation and assets. The board, in mrtigahon, has sourced for Bills of Quantity from Department of Lands, Survey and Housing and appled for development funds for refurbishment of a block that has been donated by the Bondo Sub county Commissioner. The requests are pending at the offices of Director of Procurement and that ofthe Interim County Secretary. 5.0 WORKPLAN TO FORMULATE AND PROMOTE VALUES AND PRINCIPLES The board plans to launch the Siaya County Publrc Service Board Strategrc Plan 2014- 20 I 9 and the Sraya County Public Servtce Board Btll (proposed), rn 2015 to ensure sustalnable development and continuity of good governance rn the rmplementatlon of its statutory functions and powers,aswellasthetenetsof Article l0and232of theConstitution Theboardshallensurepubhcpartrcrpatronanddemocracyintheprocess The board plans to exercise its powers under sectron 59 (4) (a) and (i) of the County Govemments Act. 2012 to lnform and educate Sraya County PublicOfficersandthepubhcaboutthevaluesandprrncrplesandrecommendtotheCountyGovernmentofSiaya effectrvemeasurestopromotethe values and principles. The board wrll assrst the county in the formulation and rmplementation of programmes rntended to rnculcate ln the pubhc officers and the pubhc the duty to uphold the values and princrples. It wrll contrnuously assess and report on the status of complance wrth the values and pnncrples and hear complaints on the same and recommend actrons to be taken on the issues raised. It wlll continue vislting the various work stations, offices and bodies at all levels within the County to cnsure compliance to the values and principles in Article lO and232 of the Constrtutron of Kenya,2010. The board has initiated partnership, networking and exchange programmes locally and overseas ln its quest to cover a wider margin tn the promotlon of values and principles In lts thrrd year,20l5. An example are the recent visits to the Public Servtce Commission of Kenya, The Drrectorate of Public Service Management and the UN Habrtat. 6.0 CONCLUSION The board wlll strive to enhance, promote and entrench the tenets of Article l0 and 232 of the Constitution of Kenya 2010 rn the pubhc service and the pubhc of Sraya County.
