These Gurdehnes may be cited as the National Police Service Gurdelines on the Recrurtment and Removal of the members of the County Pohcrng Authorrty, 2014. 2. In these Regulatrons, unless the context otherwlse requires- "Act" means the Natronal Pohce Service Act, 201 1 ; "Authorrty" means the County Pohcing Authonty established under sectlon 4l(l) ofthe Actl "Cabinet Secretary" means the Cabinet Secretary for thc tlme berng responsrble for matters relatlng to the Servlce. 3. These GurdeLnes provides for the procedure on nomination, appointment, removal from offrce, vacancy of office and filling of vacancy of members of the Authonty. 4 (l) Wrthrn fourteen days upon the coming into operation of this Guidelines or on the occurrence of a vacancy, each Governor shall through therr respective county public service board write to the head of the respectrve organizattons specrfied under sectron l (l) (b) (c) (d) and (e) requrnng the names of the person to be appointed as the ex- officro members of the Authonty. / I i I I I 9th January, 2015 THE KENYA GAZETTE 35 (2) Wrthout preyudrce to the generality of the provrsrons of paragraph (l), the Governor and the county public service board shall wnte to - (aJ the Drrector-General, National Intelhgence Servrce to nomrnate a representativel (b) the Inspector-General to nomrnate the head of the Kenya PoLce Servrce. the head of the Adminrstratron Police Servrce and the head Drrectorate of Cnmrnal Investigatlon, (c) the Clerk , County Assembly to nominate a representative; and (d) the chairperson of the County Securrty Committee. 5. (l) The county pubhc service board shall, u,rthrn fourteen days on the coming into operation of these Guidehnes or on the occurrence of a vacancy, advertrse in at least one national or county newspaper of wide circulatron within the county, requesting for quahfied persons to be nominated from the organizatlons listed under sectron 4l (l) (0. (2) The county public service board shall, wrthrn fourteen days of receipt of the application under paragraph (1 )- (a) shortlist qu4lified persons; (D) interviewl and (c) submit a list of quahfied persons to the Govemor for appointment. (3) In considenng the nominees identifred by the organizations specrfied under section 4l (l) (0, the county public service board shall require the organizatrons to produce- (a) srgned mrnutes as evidence of an accountable process of nomrnatloni (b) evidence ofcompliance with any statutory obhgations; and (c) vetting form to establish that the nominee has comphed wrth the prescribed criteria for appointment. (4) The Govemor shall, where he approves the names submitted to him by county pubhc service board under paragraph (2), within two days of receipt of the names of the successful applicants, forward the names of the successful persons to the County Security Committee and subsequent thereto, the county assembly for approval , in accordance with the provisions of section 41(3). (5) The county assembly shall, within seven days of the day it next sits after receipt of the names of the applicants under paragraph (4), vet and consider all the apphcants, and may approve or reject any or all of them. (6) Where the county assembly approves the apphcants, the Speaker of the 'county assembly shall forward the names of the approved nominees to the Governor for appolntment. (7) The Govemor shall, wrthin seven days of recerpt of the approved nominees from the county assembly, by notlce ln the Gazette, appoint the members under section 41 (f) (8) Where the county assembly rejects any nominatron, the Speaker of the county asdembly shall within three days communrcate its decision to the Governor and request the Governor to submit fresh nominations. (9) Where a nomrnee is rejected by the county assembly under paragraph (8), the Govemor shall withrn seven days, submit to the county assembly a fresh nomination from amongst the persons shortlisted and forwarded by the county pubhc service board under paragraph (2). (10) If the counfy assembly reJects any or all of the subsequent nominees submitted by the Governor for approval the provisrons of paragraphs (l) to ( ) shall apply. (11) In the appointment of the members of the Authorrty referred to in section 4l(l)(0, the Govemor and county pubhc servrce board shall uphold the princrples and values in the Constitution and the provrsions of sectron 4l (4) and 4l (5) of the Act. 7. (1) a person is quahfied for apporntment as member of the Authonty under sectron 4l (l X0 rf that person- (a) rsacruzenofKenya; (b) sahsfies the requrrements of Chapter Srx of the Constitution; (c) is a resident, conducts business or rs employed in the county for a continuous period of not less than three years; (2) A person shall not be qualified for appointment as a member of the Authority under section 4l (l) (0, if that person- (a) rs an undischarged bankrupt; (b) has been removed from office forcontravening the Constitution or any other law; (c) is not a crtizen of Kenyal or (d) has rn the conduct of hrs or her affarrs not met any statutory obhgatron; 8. The Charrperson and members of the Authority shall on being gazette subscnbe to an oath of set out in the Schedule. 9. (l) The office of a member of the Authorrty shall become vacant rf the holder- (4) dies; (D) resigns from office by a notice rn writing addressed to the chairperson; or (c) is removed from office rn accordance with these Regulations . (2) Where a vacancy occurs ln the membership of the Authority, the Govemor shall appoint a replacement rn accordance wlth guldehne 5or6. 10. A member of the Authorrty appointed pursuant to these Guidelines, may be removed from office for- (a) inabilrty to perform the functrons of office arising from mental or physrcal rncapacrty; (D) violatron of the Constrtutionl bankruptcy; incompetence; (e.) convicted of a felony and sentenced to imprisonment for a term exceeding six months; A gross misconduct or misbehavior; or (g) any other justrfiable cause or upon an order of a court of competent junsdlctlon. ll. (l) A person desrrrng the removal of a member of the Authority, other than the charrperson, on any of the grounds specified in gurdehne l0 may present a petltlon to the Govemor setting out the alleged facts constituting that ground. (2) The Governor shall, subJect to Artrcle 47 of the Constirution, consider the petition, and, if he rs satrsfied that it discloses a ground under gurdeline l0 - (d,) investrgate the matter expeditiously; (b) consider the facts or any evidence arising out of the investigation under paragraph (a). (3) Where the Governor is satisfied that the allegation is based on facts, he shall exercise his powers to remove him from the membership of Authority. (4) If the Governor finds that the allegation made is frivolous and has no merit he shall drsmrss the allegation and inform the member his grounds of dismissal. (5) Where the member rs drssatrsfied with the decision of the Govemor he may apply for review of the decision by the Cabinet Secretary. (c) (d) t I T I (6) On receipt of the request for review under paragraph (5), the Cabinet Secretary shall notify the member in writing of the petition to rcmove him and shall provide the member with an adequate opportunity to defend himself. (7) The Cabinet Secretary may vary or affirm the decision of the Governor and shall notify the Govemor and member of his decision in writing. (8) Where the member is removed from the membership of the Authority under this guideline the vacancy shall be filled in the manner set out in these Guidelines.
